KUALA LUMPUR: A construction company is suing a Datuk Seri and three others for fraud involving a timber project in Hulu Selangor.
Nice Garden Sdn Bhd is claiming that it was offered a joint-venture project for logging work at Bukit Belata Forest Reserve and had entered into an agreement for the job last year.
It has named Infra Penaga Sdn Bhd and its three directors Datuk Seri Hasan Ayuob, Datuk Abdul Samad Othman and Adnan Shah Che Yusoff as defendants.
It stated that the defendants had given a false representation by saying that Hasan was a special officer to the Prime Minister and that the company had been certified as the registered logger by the Selangor Forestry Department.
In the statement of claim filed on Oct 5, Nice Garden said it later found that the project was non-existent.
It is asking for a declaration that the defendants had cheated it and that the joint-venture agreement dated March 25 last year entered between the parties was invalid.
It is asking for an order for the defendants to pay RM700,000 in damages, interests and other damages to be assessed.
Nice Garden is also asking Abdul Samad to return RM256,500 which was paid by the plaintiff to him over the project, costs and any other relief deemed fit by the court.
Speaking to reporters yesterday, Nice Garden’s lawyer Nazri Hussain said that so far his client had only managed to serve a copy of claim to Hasan by registered mail.
“Hasan has personally received it but he has not appointed a lawyer for his defence yet. We have not managed to serve this suit to three other defendants as the registered mail could not be delivered,” he said.
High Court judge Amelia Tee Hong Geok Abdullah set Nov 22 for case management.
